General terms and conditions

Article 1 – Definitions
In these terms and conditions the following terms shall have the following meanings:

  1. AlertSignals : the company AlertSignals, registered with the Chamber of Commerce under number 97048267, established in the Netherlands.

  2. Customer : any natural person or legal entity that enters into an agreement with AlertSignals.

  3. Products : all items offered by AlertSignals in the field of emergency signals, safety equipment and bird deterrents, including but not limited to pyrotechnic signalling equipment (category P1), acoustic and optical equipment, aids such as emergency whistles and other products that contribute to safety and protection.

  4. Agreement : any purchase agreement between AlertSignals and the Customer, including the associated terms and conditions.


Article 2 – Applicability

  1. These terms and conditions apply to all offers, orders and agreements with AlertSignals, unless otherwise agreed in writing.

  2. By placing an order, the customer declares that he/she has read and agrees to these terms and conditions.


Article 3 – Offer and information

  1. All offers and prices from AlertSignals are without obligation and may be changed at any time.

  2. AlertSignals makes every effort to describe its products as completely and accurately as possible. However, images and descriptions are for illustrative purposes only; actual results may vary.

  3. Products are intended solely for the purposes described by AlertSignals. Any use contrary to instructions or legal requirements is entirely at the customer's own risk.


Article 4 – Order and delivery

  1. Orders will be processed after full payment has been received, unless otherwise agreed.

  2. Delivery will take place at the address specified by the customer.

  3. Delivery times stated are indicative. Exceeding delivery times does not entitle the customer to compensation or termination of the agreement.

  4. AlertSignals reserves the right to refuse orders if there are doubts about proper use or if there is a conflict with legal provisions.


Article 5 – Risk and liability

  1. After delivery, the risk of loss, damage or use of the products passes to the customer.

  2. AlertSignals is not liable for damage caused by incorrect, improper or unsafe use of the products.

  3. The customer is solely responsible for compliance with applicable laws and regulations regarding the possession, transportation and use of the products.


Article 6 – Right of withdrawal

  1. Private customers have the right to cancel their order within 14 days of receiving the products without giving any reason.

  2. Returns are only possible if the products are returned unused, undamaged and in the original packaging.

  3. Return shipping costs are the responsibility of the customer.

  4. AlertSignals reserves the right to refuse returns that do not meet the conditions.

  5. Products that cannot be returned for safety reasons (e.g. opened or activated signalling devices) are excluded from the right of withdrawal.


Article 7 – Warranty

  1. AlertSignals guarantees that the delivered products comply with the agreement and the applicable legal requirements within the EU.

  2. The warranty does not apply to defects resulting from improper or incorrect use, or when products have been modified or resold in violation of the terms of use.


Article 8 – Force Majeure

  1. AlertSignals is not liable for any delay or failure in the performance of the agreement if this is the result of circumstances beyond its control.

  2. Force majeure includes, but is not limited to: strikes, transport problems, supplier disruptions, government measures, natural disasters, and other circumstances that prevent the normal performance of the agreement.


Article 9 – Privacy

  1. AlertSignals processes personal data solely for the execution of the agreement and in accordance with applicable privacy legislation.

  2. Personal data will not be provided to third parties unless this is necessary for delivery or is legally required.


Article 10 – Applicable law and disputes

  1. All agreements and these terms and conditions are exclusively governed by Dutch law.

  2. Disputes will be submitted in the first instance to the competent court in the district where AlertSignals is established.
